Official guidelines and regulations for real estate advertising

Real Estate Advertising Regulations

First:

Real estate service providers must provide real estate advertisements in accordance with the real estate advertising regulations issued by the General Authority for Real Estate on 12/10/1442 AH.

Second:

Without prejudice to the competencies of the relevant authorities and the jurisdiction of the General Commission for Audiovisual Media, real estate advertising must adhere to the following:

  • Ensure honesty and integrity.
  • Avoid anything that may cause confusion or mislead the public.
  • Comply with the general guidelines for advertising content regulations.
  • Adhere to the content issued by competent authorities regulating ethical and media content across all information mediums (traditional and electronic).
  • Use official names for cities, neighborhoods, streets, and types of real estate, with the addition of commonly known names if applicable.

The advertisement must contain the following information:

  • State that it is an advertisement.
  • Specify the purpose (sale, rent, investment, etc.).
  • Specify the type of real estate.
  • Name of the advertiser and their status (owner, representative).
  • Advertiser's license number if it is a real estate office, marketer, or holds a freelance document.
  • Location of the property, including at least the city, neighborhood, and plan number if available.
  • An effective means of communication with the advertiser.

Disclosure of real estate information as follows:

  • Area of the property.
  • Any existing disputes regarding the property.
  • Mortgage or restrictions that prevent or limit the property's use or disposal.
  • Rights and obligations on the property not documented in the property document.
  • Services related to the property.
  • Information that may affect the property, such as warranties, duration, compliance with Saudi building code, and the property's age, among others.

Third:

The real estate advertisement on the electronic real estate platform must include, in addition to what is mentioned in clause (Second), the following:

  • Description of the property, including its type, age, contents, and any influential description such as the width of the street on which it is located, the property's facade, etc.
  • Property boundaries and dimensions.
  • Price of the property.

Fourth:

Without prejudice to the competencies of relevant authorities, it is prohibited to include any of the following in real estate advertising:

  • Violation of Islamic instructions or the laws and regulations in the Kingdom or prevailing customs.
  • Offensive to public decency.
  • Violation of intellectual property rights.
  • Negative exposure to competitors or private sector establishments or others.
  • Statements or indications that imply discrimination against anyone.
  • Misleading images, data, locations, or perspectives not related to the advertised property.
  • The logo or name of the Authority or any other government entities without prior permission.

Fifth:

It is prohibited to publish fake real estate advertisements for the purpose of collecting data from recipients or the public or for any other purpose.

Sixth:

The real estate advertisement must be removed within a period not exceeding two days from the date the purpose is fulfilled or expired.

Seventh:

The Authority monitors compliance with these regulations and refers violations to the relevant authorities to take the necessary legal actions.

Eighth:

The following are exempt from the application of these regulations:

  • Real estate advertisements from government agencies.
  • Off-plan sale or lease advertisements.
